As per the provisions contained in the Prevention of
Corruption Act, 1988, the Anti Corruption Bureau conducts enquiries against
government servants and other public servants.  As
per the definition of public servant provided in the act, an elected member
of Gram Panchayat, Municipality, Municipal Corporation and the office
bearers of educational, scientific and social institutes receiving government
aid are deemed to be public servants.
Under the provisions of this Act, the A.C.B. initiates enquiry into
the complaints pertaining to corruption by the State Government Servants.
(The complaints pertaining to corruption by Central Government employees,
are dealt with by the Anti Corruption Bureau of the C.B.I.)
The A.C.B. deals with three types of cases, viz (1) Trap Cases (2)
Disproportionate Assets (D.P.A.) and (3) Cases of criminal misconduct
causing loss to government and obtaining pecuniary advantage to herself/himself
by misusing powers or abusing position.
(1)Trap Cases :- In trap cases, the complainant is required to attend
the office of the A.C.B. & lodge preliminary complaint against the
Government/Public Servant, who demands bribe. A.C.B. may verify the
said information & arrange trap against such Public Servant
(2) Disproportionate Assets :- A.C.B. conducts enquiry on the information
provided by a member of Public against a public servant. Action is taken
after considering the Income, Expenditure, Assets, Investment etc. of
the Public Servant. It is essential that, the information provided is
reliable & verifiable.
(3) Misuse of Power :- In such type of cases, an enquiry is conducted
on the allegations that Government Employee or Officer, by misusing
and/or abusing his power with malafide intention, causes financial loss
to the Government and obtains pecuniary advantage to himself.
Clarification :- The procedural lapses in daily routine functioning
of the Government or breach of minor rules, do not fall under the purview
of A.C.B. In such complaints, enquiry is conducted by the Head of the
Concerned Department.
If the complainant is not happy with the enquiry, he/she can bring it
to the notice of Hon'ble Lok Ayukta, Maharashtra State, on the following
